These Terms of Use (“Terms”) govern your access to HotelsNearMe.com and related verified traveler services operated by Vertical Health Network (“HotelsNearMe,” “we,” “us”). Please read them carefully.
Agreement to these Terms
By accessing or using the site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site. Additional terms may apply at verification or checkout; those terms control for the specific transaction if they conflict with these Terms.
Eligibility
You must be at least eighteen (18) years old and able to enter a binding contract. You represent that information you provide is accurate and current, and that you will not misuse the program—including by circumventing human verification, reselling restricted rates, or using automated tools to access offers.
Verification
Certain rates or features require successful identity verification through Verify.CyberInsurance.com or another approved provider. Verification decisions, timing, and data handling are governed by the applicable provider terms and privacy notices in addition to ours. We may revoke access if verification fails, expires, or if we detect fraud or abuse.
Program and bookings
HotelsNearMe is not a hotel brand or property operator. We facilitate access to negotiated or member-style rates where available. Bookings may be fulfilled by hotels, wholesalers, or online travel agencies; their confirmation, cancellation, and change policies apply. Savings percentages shown on the site are illustrative; actual pricing depends on property, dates, inventory, taxes, fees, and eligibility rules.
Acceptable use
You agree not to violate law, infringe others' rights, probe or disrupt our systems, scrape or harvest data without permission, impersonate others, or interfere with verification or rate integrity. We may suspend or terminate access for violations.
Intellectual property
The site, logos, text, and software are owned by HotelsNearMe or licensors and protected by intellectual property laws. You receive a limited, revocable license to use the site for personal, non-commercial purposes in accordance with these Terms.
Disclaimers
THE SITE AND PROGRAM ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, ERROR-FREE OPERATION, LOWEST PRICE, OR AVAILABILITY OF ANY RATE OR PROPERTY.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOTELSNEARME AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR PROGRAM. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING FROM THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE SUCH LIMITATIONS ARE PROHIBITED BY LAW.
Indemnification
You agree to defend, indemnify, and hold harmless HotelsNearMe and its affiliates from claims arising out of your misuse of the site, violation of these Terms, or violation of third-party rights, except to the extent caused by our gross negligence or willful misconduct.
Disputes and governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where mandatory consumer protections in your jurisdiction require otherwise. Any dispute will be resolved in the state or federal courts located in Delaware, unless applicable law grants you the right to bring claims in your home jurisdiction. You may have rights to opt out of certain dispute procedures where required by law.
Changes and termination
We may modify these Terms or discontinue features at any time. Continued use after changes constitutes acceptance of the revised Terms. We may terminate or suspend your access for any reason, including violation of these Terms.
